BULD DPD RI Suggests New Forms of Regulation in the Mining Sector

JAKARTA, dpd.go.id - The Regional Legislative Affairs Agency of the Regional Representatives Council of the Republic of Indonesia (BULD DPD RI) requested an explanation from the Ministry of Energy and Mineral Resources (ESDM) regarding national policies in the field of mineral and coal mining, new energy, renewables and conservation energy and its implications.

Head of BULD Stefanus BAN Liow explained that national regulations related to mineral and coal mining, new energy, renewables and energy conservation, have implications for environmental mining management policies in the regions, therefore it is necessary to adjust quickly in the formation of new regulations.

"This national regulation has implications for the regions and their authority to issue permits and legal products in the mineral and coal mining sector," Stefanus said at the DPD RI Building, Jakarta, Wednesday (28/9).

The senator from North Sulawesi hopes that the regions will quickly make adjustments through changes to Regional Regulations (Perda) in the field of mineral and coal mining. In addition, the regions also make adjustments to mining business activities in forest areas, through harmonization of the laws and regulations above them. "Of course the regions must also pay attention to environmental protection and management instruments in order to control environmental impacts arising from mining business activities," he explained.

Deputy Head of BULD Abdurrahman Abubakar Bahmid added that this policy had a great influence on the regions. Since the beginning, the region has been very prone to conflicts over this policy, such as during land acquisition and implementation. "The area really feels like the result of mining damage, from the initial acquisition, implementation to profit sharing. Everything creates conflict," he explained.

Meanwhile, DPD RI Member from Papua Province Yorrys Raweyai emphasized that DPD RI was present as a solution not as a trigger. Where after the decision of the Constitutional Court related to Law no. 11 of 2021 concerning Job Creation has raised debate regarding business licensing in the mining sector. "The Constitutional Court's decision regarding the Job Creation Law has actually caused public confusion regarding mining permits," he explained.

On the same occasion, DPD RI Member from Aceh Province Abdullah Puteh proposed the establishment of a special bureau for mining permits. As a result, the existence of this bureau will make it easy for the public to obtain permits. “I propose to have a special mine licensing bureau. This is in accordance with Pak Jokowi's words that 'the sooner the better' so that people get permits quickly," he said.

The Director General of Minerals and Coal at the Ministry of Energy and Mineral Resources Muhammad Idris F Sihite explained that business licensing in the mineral and coal mining sector after the Job Creation Law must be in accordance with the mining jurisdiction. So the area includes land space, sea space, land under the waters, and the continental shelf.

"If the area is to be cultivated, it will first be determined as a mining area. The process must involve the regional government and the community and be adjusted to the spatial plan," explained Idris.

In addition, Secretary of the Directorate General of New, Renewable Energy and Energy Conservation of the Ministry of Energy and Mineral Resources, Sahid Junaid explained that Indonesia has great, widespread and diverse potential for new renewable energy (EBT). So it can support the resilience of the potential and utilization of national EBT, and the achievement of the EBT mix target.

"We have utilized 0.3 percent of the total potential so that the opportunities for developing EBT are very open. Moreover, it is supported by environmental issues, climate change, and increased electricity consumption per capita," explained Sahid.*fan
