At the IPPAT 35th Anniversary National Seminar, LaNyalla Reminds the Government about the Land Mafia and Agrarian Reform

SURABAYA, dpd.go.id - Chairman of the Republic of Indonesia DPD, AA LaNyalla Mahmud Mattalitti, alluded to the land mafia and agrarian reform when delivering the Keynote Speech for the National Seminar on the 35th Anniversary of the Association of Land Deed Making Officers (IPPAT) of the East Java Region Management at the Dyandra Convention Center Surabaya, Wednesday (28/9/2022).

LaNyalla reminded President Joko Widodo (Jokowi) of his message in 2017 about the land mafia which must be eradicated from its roots.

At that time, President Jokowi firmly demanded that the land mafia be beaten indiscriminately. The senator from East Java also warned about agrarian and spatial planning conflicts, especially those related to plantations and forestry lands.

This relates to patterns of land encroachment without permits and practices of irregular expansion of land in the field.

"Farmers and small-scale gardeners are those who often become victims. We can also access data on this issue at several institutions that are observing agrarian issues, especially the Consortium for Agrarian Reform or KPA," said LaNyalla.

According to him, the mafia is always synonymous with groups that commit crimes in a planned, neat and systematic way. The meaning is clear, he does not work alone.

"So if anyone is uncovered and caught by law enforcement officials, there will definitely be a long chain. There are big bosses, officials, liaisons and field operators," said LaNyalla.

The mafia carry out land crime operations involving a group of people working together to illegally own or control other people's land. They are used to using methods that break the law, but are neatly arranged, planned and systematic.

According to LaNyalla, this is a challenge for law enforcement officials, especially the Anti-Land Mafia Task Force at the ATR/BPN Ministry, including the Attorney General's Office and the Police.

"This is also where the role of Land Deed Officials is demanded to be actively involved in eradicating the land mafia," said LaNyalla.

According to LaNyalla, the Official for Making Land Deeds, they have to work extra hard to carry out a double check mechanism for the information and statements obtained. Why is this important, because, LaNyalla thinks it will be a separate problem if the data and information provided to the Land Deed Making Official turns out to be fake or incorrect.

LaNyalla also asked the ATR/BPN Ministry to provide check and re-check rooms that are easy to access by Land Deed Making Officials in validating and verifying. He also requested that the Anti-Land Mafia Task Force must also be easily accessible to the wider community in all institutions, according to the mandate President.

"To be honest, not a few people have complained about land grabbing and agrarian issues to my office in DPD RI. This means that there are still difficulties for the wider community to access the desk or desk of the Anti-Land Mafia Task Force formed by the Ministry and Law Enforcement Officials. ," LaNyalla said.

The following problem that LaNyalla explained was about agrarian reform, especially in dealing with spatial and agrarian issues related to plantation, forestry and mining lands.

According to LaNyalla, the main essence of agrarian reform is a systematic effort by the state to rearrange land and land ownership so that inequality does not occur in a country.

"Especially by focusing on the redistribution of land to small farmers, indigenous peoples, and landless people," said LaNyalla.

To this day, this issue is still a chaotic part of the agrarian problem in Indonesia, apart from the land mafia problem as mentioned above. Even today, LaNyalla said that the government and plantation companies have not changed the way they do business in the plantation sector.

"So it is not surprising that the face of development in the plantation sector is still full of agrarian conflicts, the denial of community rights, violations of human rights, to the systematic impoverishment of local communities due to the unfair nucleus-plasma partnership system, which even sucks the sweat of small farmers," said LaNyalla.

The orientation of economic development in the plantation sector has not changed, it remains oriented towards the interests and profits of entrepreneurs and large business entities. This kind of political-economic orientation is as if our country has not moved on from the plantation system during the colonial and New Order eras.

The government still grants HGU (Hak Guna Usaha) for decades. That way, only big businessmen and companies will get this right. The process of granting HGU by investors and bureaucrats is carried out behind closed doors, thereby fertilizing the chain of bribery practices. "This has become an acute and structural problem," said LaNyalla.

On the other hand, the process of granting HGU also means taking over community land. He said, President Jokowi had indeed taken control of abandoned lands, in response to public criticism. "But land In fact, the regulation has also been offered to groups of investors who are able to manage it with a feasibility study that meets the requirements, not at all for the redistribution of land to communities and small farmers who do not own land," explained LaNyalla.

This was clearly recorded in the president's statement at the 2nd Ummah Economic Congress of the Indonesian Ulema Council, in which the President offered these lands to organizations or mass organization business entities that were able to manage them with a business feasibility approach.

This is where, according to LaNyalla, the crucial problem lies, because it is again the group that will get the land resulting from the control of abandoned land, which has access to capital, controls technology, and markets. "This means that the business elite, large business entities, and the returning political elite will monopolize the land," explained LaNyalla.

In fact, the highest priority for the allocation of abandoned land and problematic HGUs should be aimed at the agenda of resolving agrarian conflicts and redistributing abandoned land for the benefit of the common people, agricultural labourers, landless and evicted communities, as well as rights custom Society.
