Addendum to the 1945 Constitution, Chairman of DPD RI Suggests that DPR RI should also be Occupied with Election Contestants from Individual

YOGYAKARTA, dpd.go.id - The idea of returning the original text of the 1945 Constitution to be refined through an addendum is increasingly being voiced by the Chairman of the DPD of the Republic of Indonesia, AA LaNyalla Mahmud Mattalitti.

He proposed changing the original system through an addendum technique, so that individual election participants entered as part of the DPR RI.

"As an offer to refine the Original Manuscript Constitution using the Addendum Technique, I propose that the DPR should not only be occupied with election participants from elements of political parties, but also occupied with election participants from individual elements," said LaNyalla in an FGD themed Roadmap to Return to the Nation's Zero Point. LaNyalla explained, in the original design of the state system that was formulated by the nation's founding fathers, it did not recognize the Bi-Cameral System. There was no discovery about the DPD elected through elections.

The MPR, which is the embodiment of the people, can only be filled through two channels. Namely the path chosen through elections and the path sent. So that it only contains elected DPR members and regional envoys and group envoys sent.

"Because DPD members are currently, in essence, (as same as DPR members) elected through general elections, it is only natural for DPD RI members to move to one room in the DPR RI," he said.

According to the Senator from East Java, there are at least three positive impacts if there is an individual element as a member of the DPR RI.

The first is to strengthen the check and balances mechanism for the executive. Second, preventing a large coalition of political parties with the government that harms the interests of the people. The third is as a counterweight and determinant in making important decisions in the DPR RI.

"So that decisions in the DPR RI, especially those related to the drafting of laws, are not only determined by political parties," said LaNyalla in the discussion held by the UGM Council of Professors and the Pancasila House.

While the Regional Envoys are still filled with regional envoys, who ideally are inhabited by the Kings and Sultans of the Archipelago. Meanwhile, Group Delegates are filled by delegates from Organizations and Professionals.

According to LaNyalla, regional envoys and group envoys must be given the right to provide considerations that must be received by the DPR RI in drafting laws. This is at the same time strengthening the function of Public Meaningful Participation.

"So that the end result is, we strengthen the state system that has been formulated by the founding fathers of the nation, without changing the structure or construction of the state system, where the incarnation of the people must be in the Highest Institution of the State," he said.

Because the current system, which is the product of amendments to the 2002 Constitution, according to LaNyalla, has proven to have failed to create a sovereign, just and prosperous Indonesia.

What has happened is precisely the increase in economic disparity and the strengthening of the grip of the economic oligarchy to control and hold power hostage.

This system is also increasingly producing injustice that transcends boundaries and is the cause of structural impoverishment from Sabang to Merauke.

"This is why the state budget is always minus and covered by debt with high interest. Non-tax state revenue is not comparable and very far from the potential wealth of Indonesia's earth, water and space. Ironically, part of the debt money has been used for routine financing and debt interest payments, " he explained.

This happened because Market Sovereignty had replaced State Sovereignty. The economy is not structured by the State, but allowed to be structured by free market mechanisms.

"That's why there is no choice. The system emergency caused by the 2002 Constitutional Amendment accident must be ended by returning to the original formulation of the state system and the Pancasila economic system," he said.
