The Original Manuscript of the 1945 Constitution does not Recognize the Bicameral System, LaNyalla: It Must be Corrected through Addendum Techniques

BALI, dpd.go.id - The discourse for the 1945 Constitution to return to the original text initiated by the Chairman of the DPD RI, AA LaNyalla Mahmud Mattalitti, continues to roll.

According to LaNyalla, after 20 years of amendments to the constitution in 1999-2002, there were many paradoxes and deviations from national ideals.

One of the things that becomes a crucial question if the 1945 Constitution returns to the original text, is the absence of a bicameral system. Thus, the House of Regional Representatives of the Republic of Indonesia (DPD RI) which was elected through elections is no longer known.

In his oration while filling out the Public Lecture on Nationalism in Bali, LaNyalla thoroughly discussed this.

"Therefore, I invite all of us to build a national consensus to make improvements to the Original Manuscript Constitution through amendments using addendum techniques," said LaNyalla in front of students, academics and a number of community leaders at the DPD RI Regional Representative Office for Bali, Friday (20/20 1/2021).

The senator from East Java explained that in the original system, the MPR as the highest institution was the embodiment of the people only through two channels. Namely through the election and the path that was sent. That way, the MPR only contains elected members of the DPR and delegated regional and group envoys.

"I propose that the DPR should not only be filled with election participants from political party elements, but also election participants from individual elements. Because in essence they are both elected through elections," explained LaNyalla.

He added that members of the DPR RI participating in the election from individuals will have a positive impact. First, strengthen the mechanism of checks and balances against the executive. Second, preventing a large coalition of political parties with the government that harms the interests of the people. Finally, as a counterweight and determinant in making important decisions in the DPR RI.

While the Regional Envoys are still filled with regional envoys, who ideally are inhabited by the Kings and Sultans of the Archipelago. Meanwhile, group delegations are filled with delegates from organizations and professionals.

Later, regional envoys and group envoys must be given the right to provide considerations that must be received by the DPR RI in drafting laws. This is at the same time strengthening the function of Public Meaningful Participation.

"So that the final result is, we strengthen the state system that has been formulated by the founding fathers of the nation, without changing the structure or construction of the state system, where the embodiment of the people must be in the Highest Institution of the State," said LaNyalla.

Regarding the method, LaNyalla invites all the nation's children to build a national consensus, so that this nation returns to Pancasila.

"After returning to the original text of the 1945 Constitution, an amendment was made and the weaknesses were refined using an addendum technique, without changing the state system," he said.

According to LaNyalla, this must be done so that we don't give opportunity to the deviant practices that occurred during the Old Order and New Order eras.

On that occasion, the Chairman of the DPD RI was accompanied by a number of Senators from Bali, namely Made Mangku Pastika, Bambang Santoso and Shri IGN Arya Wedakarna and Senator Bustami Zainuddin (Lampung).

A number of academics were also present, they are community leaders, religious leaders and students from various universities.(*)
